Probity diartikan sebagai tindakan atau perbuatan yang menerapkan prinsip kejujuran, integritas, dan kebenaran. Konsep probity tidak hanya digunakan untuk mencegah terjadinya korupsi atau ketidakjujuran, tetapi juga untuk memastikan bahwa proses penyelenggaraan kegiatan sektor publik, seperti proses pengadaan barang/jasa, penjualan aset, dan pemberian sponsor/hibah dilaksanakan secara wajar, objektif, transparan, dan akuntabel.

Terkait dengan proses pengadaan barang/jasa dan mengacu pada pengertian di atas, probity diartikan sebagai good process yaitu proses pengadaan barang/jasa dilakukan dengan prinsip-prinsip penegakan integritas, kebenaran, dan kejujuran untuk memenuhi ketentuan perundangan yang berlaku.

Berdasarkan pengertian di atas, Probity Advice dapat didefinisikan sebagai kegiatan pemberian pendapat atau saran yang dapat dilakukan pada tiap tahapan pengadaan yang menerapkan prinsip probity sekaligus manajemen risiko yang bertujuan untuk mencapai value for money dalam pengadaan barang/jasa.

Berbeda dengan proses probity audit yang bersifat pengawasan dan dilakukan pada akhir masing-masing tahapan, proses Probity Advice bersifat pendampingan dan dapat dilakukan bersamaan dengan masing-masing tahapan proses pengadaan barang/jasa sehingga dapat lebih mencegah terjadinya masalah.

Probity Advice utamanya dilakukan terhadap paket pekerjaan dengan kriteria sebagai berikut:

1. Paket pekerjaan berhubungan dengan kepentingan masyarakat luas atau menyangkut pelayanan dasar masyarakat;
2. Kompetensi Sumber Daya Manusia yang dibutuhkan tidak dapat dipenuhi oleh Kementerian/Lembaga/Perangkat Daerah/BUMN/BUMD/BLU/BLUD/PTN-BH;
3. Apabila dilakukan Probity Advice akan memberikan nilai tambah dari pada dilakukan sendiri;
4. Apabila dilakukan Probity Advice dapat meminimalisir risiko hambatan/kegagalan penyelesaian pekerjaan;
5. Paket pekerjaan yang berpotensi menimbulkan konflik kepentingan;
6. Paket pekerjaan sangat sensitif secara politis; atau
7. Paket pekerjaan yang bernilai relatif besar dibandingkan dengan nilai paket-paket pekerjaan yang lain.

Probity Advice harus dilakukan sesuai dengan prinsip probity, untuk mewujudkan pengadaan barang/jasa dilaksanakan sesuai dengan prinsip-prinsip dan etika pengadaan barang/jasa.
